We shall not be liable for the activities of other persons such as, but not limited to the following: cyber-terrorists, manufacturers, and local and foreign governments, as well as for the delay in the performance of orders or delivery of products, when such delay is, directly or indirectly, caused by: force majeure, persons engaged in criminal activities as defined and penalized under the criminal and special laws of the Philippines, war, whether declared or not, compliance with the law, governmental acts or regulations, fire, flood, quarantine, embargo, epidemic, unusually severe weather, strike, work stoppage, acts or omissions of carriers or other causes similar to the aforementioned events.
There will be no termination of orders in the case of such a delay, and the date of delivery or performance will be extended for a period equivalent to the time lost due to the delay.
Cost and Service Adjustment Clause
In such situations wherein an increase in the costs of products is proper, the Company shall, without prior notice to customers, exercise the right to change or adjust the price in consideration of the following: product cost, utility fee, tax, manufacturing cost, promotional activities, legal and regulatory regulations, and such other fees as may be determined by the Company.
The availability and use of our services by customers may also be disallowed, ceased, or canceled, whether temporarily or permanently, subject to the exercise of the Company’s discretion in amending, improving, or modification of its services.
